Lupin Constructions LLCSOUTH FLORIDA

Terms of Service

These terms explain how a Lupin pool is planned, priced, and built, and what applies when you use this website or ask us for a proposal.

Effective September 26, 2025 · South Florida

Important note

The pool tool on this website is a planning aid. A configuration, estimate, or message on the site is not a contract, a permit, or a fixed price. Construction starts only after a written agreement.

01Acceptance of these terms

By using lupinconstruction.com, configuring a pool, or requesting a consultation, you agree to these terms. If you do not agree, please do not use the site to request work.

These terms cover the website and the planning process. The contract for a specific pool, when one is signed, governs the construction itself.

02Online pool configuration

The builder lets you explore shape, finish, coping, lighting, and extras. Those choices are a visual starting point. They do not reserve a crew, submit a permit, or lock a price.

Photos and previews are illustrations. Soil, access, engineering, and the county review can change what can actually be built on a property.

03Non-binding estimates and proposals

Any range, sample, or proposal you receive from the website or from our team is an estimate until both sides sign a written agreement. An email proposal is not an offer you can accept by reply alone.

Prices can change after we see the property, the survey, and the engineering. Allowances in a proposal stay estimates until the related choice is confirmed.

04Site evaluation

Before a price becomes a contract, Lupin Construction LLC may need to visit the property or review plans, photos, and access. You agree to tell us about known conditions that would affect the work, including easements, flooding, and structures we cannot see from the street.

A site visit is a chance to confirm the design. It is not, by itself, an agreement to build.

05Soil and groundwater conditions

South Florida soil and the water table often control how a pool is built. Dewatering, piling, or a different structure may be required after excavation starts, even when the surface looks straightforward.

If hidden conditions change the work, we will tell you what changed and what it costs before that extra work proceeds, unless a delay would risk safety or the structure.

06Survey, title, and access requirements

A current survey, and sometimes a title or easement review, is needed to place the pool, the equipment, and the setbacks. You are responsible for giving us permission to enter the property and for telling us about gates, pets, and occupied areas.

If a survey or access delay holds the schedule, the start date moves with it.

07Engineering and design documents

Structural drawings, equipment layouts, and other design documents are prepared for the agreed pool. They are instruments of the project, not a product you can reuse on another property or hand to another builder without our written consent.

We may update drawings to meet the engineer of record or the building department. Those updates are part of getting a permit, not a change to the design you already approved, unless they alter the pool you will see or use.

08Florida county permitting

Pools in Miami-Dade, Broward, Palm Beach, and neighboring counties need a building permit. Timing depends on the county, the completeness of the plans, and inspections. We do not control how long a department takes to review.

Work that requires a permit does not start until that permit is issued, except for planning and design.

09Changes to the work

If you add a spa, change a finish, move the waterline, or alter access after the agreement is signed, that change needs a written description and a price before we do it.

A change can also move the schedule. We will say so when we price it.

10Scheduling, weather, and delays

Start dates are targets. Rain, storms, inspections, material lead times, and county closures can move the work. We will keep you informed when a delay is ours to explain.

We are not responsible for delays caused by weather, the building department, utilities, or conditions that were not visible when the agreement was signed.

11Warranties and maintenance

Any warranty on the shell, the equipment, or the finishes is the warranty stated in the written agreement and in the manufacturer’s own terms. A website description is not a warranty.

Pools need normal care: water chemistry, cleaning, and equipment service. Damage from lack of maintenance, storms, or alterations by others is not a defect in our work.

12Payment terms

Deposits, progress payments, and the final payment follow the schedule in the written agreement. We may pause work if a payment that is due is not received.

Paying a deposit holds a place in the schedule. It does not, by itself, approve a design that is still being drawn.

13Limitation of liability

To the extent Florida law allows, Lupin Construction LLC is not liable for indirect or consequential losses arising from the use of this website, including lost time or a design you cannot build as configured.

Nothing on this page limits liability that Florida law does not allow us to limit, including liability for our own gross negligence or willful misconduct.

14Disputes and governing law

These terms are governed by the laws of the State of Florida. Disputes that come from the website or from a project are handled in the state or federal courts located in Miami-Dade County, Florida, unless a written agreement names a different venue or requires mediation first.

Before filing a claim about the website, write to us and give us a reasonable chance to resolve it.
